Effective date: Upon first sign-in. Please read this agreement carefully before using The Drama Desk.
1. Beta Software
The Drama Desk is currently in beta testing. It is provided as-is, without warranties of any kind, express or implied. Features may change, be removed, or behave unexpectedly. You should not rely on this software as your sole record-keeping system. Export backups regularly.
2. Student Data & FERPA
You may enter personally identifiable information about students, including names, contact details, grade levels, and other educational records. As the administrator of your school's account, you are responsible for ensuring your use of The Drama Desk complies with the Family Educational Rights and Privacy Act (FERPA), applicable state student privacy laws, and your school's data governance policies. Upstart Raven, LLC acts as a service provider and does not use student data for any purpose other than providing the service to you.
3. Data Storage & Security
Your program's data is stored in a cloud database (Supabase, hosted on AWS) and is encrypted in transit and at rest. Access is restricted to authenticated users in your organization. Upstart Raven, LLC takes reasonable measures to protect your data but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials.
4. Minor Information
This application is designed for use by authorized school theater directors, not by students or minors directly. You agree not to allow students or minors to access the administrative application. Public-facing pages (audition registration, callboard, family portal) are designed for limited, appropriate use by students and guardians.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Upstart Raven, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or disruption of operations, arising from your use of or inability to use The Drama Desk. In no event shall Upstart Raven, LLC's total liability to you exceed the amount you have paid for the service in the twelve months preceding the claim (which during beta is zero).
6. No Warranty
The Drama Desk is provided "as is" and "as available" without warranty of any kind. Upstart Raven, LLC does not warrant that the service will be uninterrupted, error-free, or that defects will be corrected. You use the service at your own risk.
7. Acceptable Use
You agree to use The Drama Desk only for lawful purposes in connection with managing an educational theater program. You will not attempt to reverse-engineer, resell, or misuse the service or any data it contains.
8. Changes to Terms
Upstart Raven, LLC may update these terms as the product evolves. Material changes will be communicated to registered users. Continued use of the service after notification constitutes acceptance of the updated terms.
9. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
